Terms of service
The agreement for using Freightiva.
Freightiva is transportation management software operated by Evolution Dispatch LLC. These terms govern its use. They are written to be read rather than skimmed past.

What the service is
Freightiva is software for freight brokers and their agencies: quoting, booking, dispatch, tracking, paperwork, invoicing and settlement. Evolution Dispatch LLC provides the software. It is not a party to the freight contracts its customers enter into, is not the broker of record on their loads, and does not take custody of freight.
Accounts
An account belongs to the organisation that created it. That organisation is responsible for who it invites, what those people can do, and keeping credentials private. Tell us at hello@freightiva.app promptly if you believe an account has been used without permission.
Acceptable use
You agree not to use Freightiva to:
- send unsolicited commercial messages of any kind, by email or text;
- upload material you do not have the right to upload, or anything unlawful;
- attempt to reach another organisation’s data, or to probe or disrupt the service;
- resell or redistribute the service without a written agreement with us.
Text messages sent through Freightiva are subject to the text message policy, which forms part of these terms. Messaging is operational only. Using it for marketing is a breach.
Text message programme
What we send. Freightiva sends operational text messages about a freight load that is already in progress: an appointment or pickup time and changes to it, a request for a location update, a reminder that a signed rate confirmation or proof of delivery is outstanding, and replies to messages a driver sends us. Every message names the load it is about. We never send marketing by text.
Who receives them. Only people connected to a load in progress — the driver hauling it, the dispatcher at the carrier that accepted it, and staff at the broker or agency that booked it. We do not buy, rent or import phone number lists.
How you opted in. A number reaches us either because the carrier gave it when accepting a load or completing their carrier packet, on a form stating that the number will receive text messages about the loads they run, or because the carrier’s own dispatcher entered it when assigning that driver to a specific load. Consent is per brokerage and is not shared between brokers.
How often. Message frequency varies and depends on the freight. A typical load produces a handful of messages between dispatch and delivery. A driver running nothing receives nothing.
Cost. Message and data rates may apply. Freightiva does not charge for the messages themselves; your mobile carrier’s standard rates apply.
Stopping them. Reply STOP to any message and that number stops receiving texts from us immediately; we send one confirmation and nothing further. Reply START to begin again. Reply HELP for help, or contact hello@freightiva.app or +1 702‑291‑8717. Stopping texts does not remove anyone from a load — dispatch continues in the app and by phone.
Your mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt‑in data and consent; this information will not be shared with any third parties. We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. Your data
Your loads, customers, carriers and documents remain yours. We process them to run the service, as described in the privacy policy. We do not sell customer data and we do not use one brokerage’s data to benefit another.
Fees
Fees, billing period and notice are set out in the order form or subscription agreed with each customer. Fees are payable in advance unless that agreement says otherwise.
Availability
We aim to keep the service available continuously and we take nightly backups, but no software is faultless. The service is provided without warranties beyond those that cannot be excluded by law.
Liability
To the extent the law allows, Evolution Dispatch LLC is not liable for indirect or consequential loss, and our total liability in any twelve-month period is limited to the fees paid for the service in that period. Nothing here limits liability that cannot lawfully be limited.
Ending it
Either side may end the subscription on the notice set out in the customer’s agreement. On termination you may export your data; we retain what we are required to retain by law, including records a broker must keep for three years under 49 CFR 371.3.
Governing law
These terms are governed by the laws of the State of Wyoming, United States.
